La inteligencia artificial y su derivada en los derechos de propiedad intelectual en la cultura: retos y amenazas

Resumen

El mundo de la cultura y, en general, en todas las disciplinas artísticas, se está viendo sacudidos por el gran avance de la Inteligencia Artificial. Los derechos de autor reconocido a los creadores por las Leyes de Propiedad Intelectual en España y en Europa, niegan la autoría de las obras realizadas por IA, mientras que ya se empieza a reconocer el copyright de las creaciones en otras legislaciones por la coautoría de la obra, lo que sin duda afectará al devenir de los derechos de autor por el reconocimiento recíproco universal y la posición inferior en la que se encuentra el autor humano frente a al autor cibernético en la actividad cultural. Por último, analizaremos la propuesta del nuevo Reglamento Europeo, base para la aplicación en los Estados miembros de programas de IA.

Artificial intelligence and its impact on intellectual property rights in Culture: challenges and threats

Abstract: The world of culture and, in general, in all artistic disciplines, is being shaken by the great advance of Artificial Intelligence. The copyright recognized to the creators by the Intellectual Property Laws in Spain and in Europe, deny the authorship of the works made by AI, while the copyright of the creations is already beginning to be recognized in other legislations by the co-authorship of the work, which will undoubtedly affect the future of copyright due to the universal reciprocal recognition and the inferior position in which the human author is compared to the cybernetic author in the cultural activity. Finally, we will analyze the proposal of the new European Regulation, the basis for the application in the Member States of the European Union of the new European Copyright Regulation of AI programs.
