Del aula a la Corte. La Opinión Consultiva de la Corte Internacional de Justicia sobre la responsabilidad de los Estados en relación con el Cambio Climático

Resumen
El artículo examina la trascendencia de la Opinión Consultiva de la Corte Internacional de Justicia (CIJ) del 23 de julio de 2025 sobre las obligaciones de los Estados frente al cambio climático. Esta resolución, calificada de histórica, surge a partir de una iniciativa de estudiantes de derecho en Vanuatu, uno de los países más vulnerables. El dictamen de la CIJ, junto con los pronunciamientos anteriores del Tribunal Internacional de Derecho del Mar (TIDM) en 2024 y la Corte Interamericana de Derechos Humanos (CIDH) en 2025, es visto como parte de una estrategia judicial que busca potenciar la acción climática internacional. La CIJ, aplicando el derecho internacional en su conjunto, refuerza la base legal de la lucha contra la crisis climática.
La CIJ dictaminó de forma “espectacularmente ambiciosa” que los Estados tienen la obligación legal de proteger el sistema climático y el medio ambiente, y que la inacción o la falta de medidas adecuadas para reducir las emisiones de gases de efecto invernadero puede constituir una violación del derecho internacional. El tribunal estableció obligaciones claras mediante una interpretación holística y coherente del derecho internacional, interrelacionando los tratados climáticos, el derecho consuetudinario, el derecho del mar y, de manera crucial, el derecho internacional de los derechos humanos.
La aportación más relevante del dictamen es la relativa a las consecuencias del incumplimiento: la CIJ concluye que la falta de diligencia debida en la prevención de daños al sistema climático constituye un hecho ilícito internacional que entraña la responsabilidad del Estado. Aunque las opiniones consultivas no son vinculantes, poseen una gran autoridad moral y peso jurídico. Por ello, se espera que este pronunciamiento estimule a los tribunales nacionales a interpretar el derecho doméstico acorde con estos estándares y abra nuevas vías para la litigación climática. En suma, la opinión es un hito que puede ser utilizado estratégicamente para presionar por políticas climáticas más ambiciosas.
