Does the wording of article 178 of the Penal Code convey what the lawmaker really wanted to?

Abstract

The wording of the criminal offense of sexual assault has undergone important
reforms since 1989. The literal interpretation of paragraphs 1 and 4 of article 178 of the
Penal Code is not entirely clear and may not reflect the will of the legislator, in addition
to creating some taxonomic confusion. This is so for three reasons: The first is that, although
sexual assault is not possible if there is consent, the text leaves that possibility open by
using, in the same sentence, the verb “assault” and the noun phrase “without consent.” . The
second is that the expression “sexual freedom” is used both as a protected legal good in the
type of sexual assaults and to refer to all the types that make up Title VIII. The third is
that section 4 omits an adverb of negation necessary to respect coherence with the rest of
the regulatory text.
