Women in captivity in "the land of Islam”

Abstract
Frontier conflicts usually lead to a careful regulation of captivity norms, given that this is
the main reason for the loss of freedom in the Islamic world. Chapters devoted to the “Holy war”
(jihād) in treatises on furūc al-fiqh tend to include numerous data in this regard, and more
specifically on the personal status of individuals, when defining their rights and obligations. The
present work focuses on the information given by some Mālikī legal sources on the issue of captive
women.
